1. About these terms
These Terms of Service govern your use of natpainting.com (the “Site”), operated by National Painting Partners LLC, an Indiana limited liability company (“National Painting Partners,” “we,” “us”). By using the Site you agree to these terms. If you do not agree, please do not use the Site.
These terms govern the Site only. They do not create a contract for painting or related services. Any services we perform are governed by a separate written agreement between National Painting Partners and the client. Where those documents and these terms differ, the written services agreement controls.
2. Information on the Site
Content on the Site is provided for general information about our services. Descriptions of capabilities, coverage, timelines, and methods are general in nature and are not commitments or offers. Project scope, pricing, schedule, and terms are established only in a written proposal or agreement signed by National Painting Partners.
3. Requests and submissions
When you submit a bid request, contact form, or partner application, you agree that the information you provide is accurate and that you are authorized to provide it. Submitting a request does not create a contract or obligate either party to proceed. Information you submit is handled as described in our Privacy Policy.
4. Acceptable use
You agree not to use the Site to attempt unauthorized access to any system, to interfere with its operation, to scrape or harvest data for unsolicited marketing, to misrepresent your identity or affiliation, or for any unlawful purpose.
5. Intellectual property
The Site and its content — text, images, project photography, graphics, layout, and the National Painting Partners name and logo — are owned by National Painting Partners or used with permission, and are protected by applicable intellectual property laws. You may view and print pages for your own business evaluation. You may not republish, redistribute, or use our content or marks commercially without our prior written permission. Third-party names and marks appearing on the Site remain the property of their owners and are used for identification only.
6. Third-party links
The Site may link to third-party websites. We do not control those sites and are not responsible for their content, availability, or practices. A link is not an endorsement.
7. Disclaimer
The Site and its content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, National Painting Partners disclaims all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, with respect to the Site. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that information on it is complete or current.
This section applies to the Site. It does not limit any warranty expressly provided in a signed services agreement.
8. Limitation of liability
To the fullest extent permitted by law, National Painting Partners and its members, officers, and employees will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or business opportunities, arising out of or relating to your use of the Site, whether based in contract, tort, or any other theory, even if advised of the possibility of such damages.
9. Indemnification
You agree to indemnify and hold harmless National Painting Partners from any claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site or your violation of these terms or of applicable law.
10. Changes
We may update these terms from time to time. Changes take effect when posted, and the “last updated” date above will be revised. Continued use of the Site after changes are posted constitutes acceptance of the revised terms.
11. Governing law
These terms are governed by the laws of the State of Indiana, without regard to its conflict-of-law rules.
